DEFINITIONS

In these Terms and Conditions:

Highland Garden Tours” is the trading name of Ernest and Sarah George.

The “Customer” means any individual receiving services from Highland Garden Tours.

The “Lead Customer” is any individual responsible for engaging the services of Highland Garden Tours on behalf of a multi-person group.

The “Tour” means any experience, activities and provisions arranged by Highland Garden Tour.

A “Private Tour” means a Booking which is exclusively for an individual or multi-person group.

Booking” means reaching an agreement between Highland Garden Tours and the Customer for the provision of services.

The “Vehicle” means any motor vehicle Highland Garden Tours uses to provide experiences.

Tours and Activities” means any aspect of the service provided by Highland Garden Tours that includes driving customers to and guiding customers around locations.

 

TERMS AND CONDITIONS

These Terms and Conditions refer to Tours provided by Ernest and Sarah George of West Porin, Strathconon, Muir of Ord, Ross-shire operating as and herein referred to as “Highland Garden Tours”.

By agreeing to these Terms and Conditions, the Customer is agreeing to be bound by them. For multi-person bookings, the Lead Customer agreeing to the Terms and Conditions for the Tour, does so on behalf of the other group members also.

The contents of www.highlandgardentours.com are for general information only and are subject to change without notice given at any time. No guarantee or warranty is given as to the accuracy of the information provided. The Customer acknowledges that such information may contain inaccuracies or errors. Highland Garden Tours expressly excludes liability for any such inaccuracies to the fullest extent permitted by law. Use of the information or material held on www.highlandgardentours.com is at the Customers own risk and the Customer will take responsibility for ensuring that any Tours meet their specific requirements. All content of www.highlandgardentours.com remains the intellectual property of Highland Garden Tours.

All Customers from out with the United Kingdom must possess a valid passport or other official identification which allows them to travel and it is their responsibility to ensure that all visa and immigration requirements are met.

Highland Garden Tours accepts customers aged 8 and over. Adult accompaniment is essential for those under the age of 18.

For groups of up to 3, Highland Garden Tours vehicle utilises a luxury all-wheel drive SUV.

Larger groups will travel in a hired Vehicle with driver, the nature of which will depend on the group size and Tour requirements.

Scottish Law dictates that smoking is not allowed in any vehicles or buildings used by the public and as such, Highland Garden Tours adheres to a strict no smoking policy.

The Tours in our portfolio do not involve lengthy walks or a high level of fitness unless expressly requested and discussed prior to booking. Some locations may involve inclines or stairs. Highland Garden Tours reserves the right to omit part of a Tour or recommend that a Customer does not participate in an element of a Tour if it is felt that they are unable to undertake safely.

If a Customer has special requirements e.g. diet or mobility restrictions, these should be discussed prior to Booking and all reasonable effort will be made to accommodate.

Customers must bring footwear and clothing suitable for the changeable Scottish weather and for Tour conditions.

Highland Garden Tours do not accept pets on any of our Tours.

 

Food and Drink

Food and Drink while Touring is not included unless specified otherwise.  Where applicable lunch and/or dinner options can be discussed prior to Booking. On our Full Day Tours time is always allocated to a lunch break and tea/coffee breaks. These can be restaurants, cafes, takeaways or food may be purchased from a supermarket but all are at the Customer’s expense.

Highland Garden Tours will provide bottled water while we travel, but no other food and drink can be consumed within the vehicle as they are viewed as hazardous both to yourselves and seat upholstery. If upholstery is marked beyond our personal ability to clean, then a fair charge will be made for professional valeting.

 

Payment

Payments can be made through WeTravel who accept all major cards. Bank Transfers are also accepted. Any additional activities, Tour extensions or other expenses can be paid in cash or via WeTravel during the Tour.

 

Cancellations

Customer Cancellations

If a Customer wishes to change any part of the confirmed booking they should inform us in writing to hello@highlandgardentours.com  as soon as possible. For cancellations, the date received by Highland Garden Tours will be the date of cancellation.

Cancellations prior to 30 days in advance of the Tour receive a 75% refund of the total paid. Cancellations between 30 and 10 days before the Tour receive a 50% refund. There is no refund for cancellations within 10 days of the tour or failure to arrive at the organised departure or pick-up point.

Highland Garden Tours will endeavor to accommodate any reasonable requests or cancellations out with the customers control and would look to accommodate a rescheduled booking if possible but cannot guarantee that we will be able to meet your request.

Shore Excursion Tours only – If the ship fails to dock we will give a refund of 92%. We retain 8% to cover bank charges and admin costs.

Highland Garden Tour Cancellations

In the unlikely event that Highland Garden Tours are unable to fulfill a Booking, we will endeavour to find an alternative guide or replacement Tour. Should this not be possible, an alternative Tour date will be offered or a full refund will be issued.

If the Tour is cancelled part way through, Highland Garden Tours will provide transportation back to your collection point and a pro rata refund for the cancelled portion of the Tour issued.

 

Booking Terms

Full payment is required at time of Booking. Payment and receipt do not imply acceptance of a Booking. A contract is only made between the Customer(s) and Highland Garden Tours upon emailed acceptance to either the Customer or their authourised Travel Agent.

On single person Bookings, it is the Customer’s responsibility to check the accuracy of their Booking. On multi person Bookings, it is the Lead Customer’s responsibility to check the accuracy of the Booking for all Customers in their group. This includes travel dates.

The Tour starts on collection from the address or point agreed with the Customer, Lead Customer or Travel Agent and travel prior to that time is not included in the Booking.

Any fee payable to third parties (such as admission fees) or guided tours outside those offered by Highland Garden Tours are not included in the Tour price unless expressly stated in the Tour description.

It is the Customer’s responsibility or that of their authorised Travel Agency to organise international travel arrangements. Where changes to travel plans occur, Highland Garden Tours cannot take responsibility for alterations or delays that impact on the Tour but will attempt to accommodate them where reasonably possible.

Out with the Tours, Highland Garden Tours would be happy to accommodate and remain flexible regarding any unique and specific requirements of the Customer or Travel Agent. There will be additional charges for these services, please contact us to discuss.

 

Accommodation

Accommodation is not included as part of your Tour. Highland Garden Tours can advise on accommodation sourcing if required but takes no responsibility for availability, cost, quality, cancellation or alteration of booking with third party suppliers.

 

Liability

A number of aspects of your Tour may be supplied by independent suppliers – such as restaurants, cafes, or entrance fees to attractions. They supply their services subject to their own terms and conditions. Highland Garden Tours will not accept or have any liability for acts or omissions (whether negligent or otherwise) of any supplier or person providing services in connection with any Tour unless such a person is employed by or under the direct control of Highland Garden Tours.

Highland Garden Tours does not accept liability for loss, damage, delay, inconvenience or consequential loss caused, unless due to our negligence, in which case liability is limited to the cost of the Tour.  Tour activities such as site visits or walks are at the Customer’s own risk.  Highland Garden Tours will not accept responsibility for accidents, injury, lack of fitness, illness, negligence or lack of punctuality attributable to the Customer.

​Notification of disability or illness should be made prior to Booking so that needs and suitability of the Tour can be discussed.

​Highland Garden Tours does not accept responsibility for loss of valuables, including camera equipment, during the Tour.

​Highland Garden Tours will use all reasonable and legal means to ensure that the Tour starts and concludes at the time agreed.  Highland Garden Tours will not incur any liability in the event of any delay due to causes out with their control.  These circumstances include but are not limited to: weather, roads, traffic, civil disturbance, industrial action, strikes, war, sickness, flood and any other event beyond their reasonable control or force majeure.

​Highland Garden Tours does not accept liability for death, bodily injury or illness unless this arises from a negligent act and/or omission of Highland Garden Tours or a representative of Highland Garden Tours while acting on behalf of Highland Garden tours during the course of the Tour.

 

Insurance and Safety

Highland Garden Tours does not accept responsibility for conditions out with their control such as weather, site closures, traffic congestion. Highland Garden Tours reserves the right to cancel or alter any Tour or itinerary where necessary.

​Highland Garden Tours strongly advises participants to have insurance cover in place for the duration of their Booking which covers them for travel, medical treatment, injury, death and repatriation as well as cancellation, curtailment and loss of, or damage to, personal possessions.

Our vehicles and guides are fully insured in accordance with current regulations.

Customers who are intoxicated through alcohol or other substances or in any way disorderly, aggressive, or belligerent will not be conveyed under any circumstances and no refund will be given. Customers must comply with all local laws including the wearing of seat belts. Failure to heed the law may result in your being reported to the Police. Any deliberate breaking of the law or drunken, disorderly or belligerent or aggressive behaviour during the journey will result in the tour being terminated immediately wherever that may be, and no refund will be given. Without exception, any person being verbally abusive or violent towards the driver will be immediately reported to the police.

 

Complaints and Enforceability of Terms

Any complaints about your Tour should be made immediately so that Highland Garden Tours has the option to discuss and rectify the issue if possible.  Outstanding complaints should be made in writing within fourteen days of the end of the Tour to;

If disputes cannot be resolved directly within six weeks, a mediator will be selected with the assistance of the Law Society of Scotland.  If mediation is unsuccessful, the Sheriff Court of Inverness shall have jurisdiction and the Scottish Law shall apply.

If any provision of these Terms and Conditions is found to be illegal or unenforceable, that shall not affect the validity and enforceability of the remainder of these Terms and Conditions.
